Patents owned by competitors can be a real barrier to your business. We often advise on infringement and validity matters in relation to patents. If you need advice on a competitor's patents or other IP, talk to us.
If a competitor's patent is a problem, one option is to apply for revocation of the problem patent. Revocation before national tribunals is one possibility. But, the most cost-effective solution is the opposition procedure in the European Patent Office (EPO). For nine months after grant, European patents are open to opposition in the EPO. If successful, opposition results in revocation of the European patent in all European countries.
We have a expertise in opposing patents at the EPO both before the Opposition Divisions and Boards of Appeal. We have the knowledge and experience as well as the advocacy skills to give you the best chance that an opposed European patent is revoked or amended in a commercially acceptable way.
